Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WelcomeIn platform, website, and related services (collectively, the "Service") operated by WelcomeIn ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

WelcomeIn is a restaurant commerce and operations platform that provides tools for:

• Direct online ordering
• Reservation and waitlist management
• Menu management
• Review and reputation management
• Analytics and reporting
• Notifications and messaging
• Merchant dashboard and operational tools
• Subscription billing management

The specific features available to you depend on your subscription tier (Basic, Standard, Pro, or Max).

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your information if it changes
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

WelcomeIn offers subscription plans (Basic, Standard, Pro, and Max) billed on an annual or monthly basis. By subscribing to a plan, you agree to the following:

• Recurring billing: Your subscription will automatically renew each billing period unless you cancel before the renewal date
• Payment: All payments are processed securely through Stripe. You are responsible for keeping your payment information current
• No commissions: WelcomeIn does not charge commissions on orders processed through the platform. Your revenue stays your revenue
• Price changes:We may change subscription pricing with at least 30 days' notice. Your continued use after the price change constitutes acceptance
• Cancellation: You may cancel your subscription at any time. Access continues until the end of your current billing period
• Refunds: Subscription fees are generally non-refundable, except where required by law

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any purpose other than its intended restaurant operations use
• Scrape, mine, or collect data from the Service without authorization
• Impersonate another person or entity

The Service, including its design, features, content, and underlying technology, is owned by WelcomeIn and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to the Service (such as menus, images, and restaurant information). By uploading content, you grant us a non-exclusive, worldwide license to use, display, and process that content as necessary to provide the Service.

You own the data you and your customers generate through the Service, including order data, guest information, and operational records. We process this data on your behalf to provide the Service.

Our use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Service integrates with third-party services, including Stripe for payment processing and providers for email and SMS delivery. Your use of these third-party services is subject to their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or content of third-party services.

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

For Max tier subscribers, service level agreements (SLAs) may apply as specified in your subscription agreement.

To the maximum extent permitted by law, WelcomeIn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify, defend, and hold harmless WelcomeIn and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may terminate your account at any time by canceling your subscription and contacting us.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
